The Courts of California have eased the public policy restrictions affecting spousal support limitations in martial agreements.

Move-away cases in child custody matters have been given clarity, allowing for "de facto" custody considerations by the court. Child support calculations no longer consider income from student loans.

The earning ability of non-earning assets can now be considered in child support calculations. The determining factor on whether proceeds from the term life insurance policies are separate or community property depends on who paid the premium during the final term prior to the insured's death.

Attorney's fees for both parties are often ordered to be paid by the higher earner.
